
AAF Lawsuit is Filed
Today several sources are reporting that a lawsuit was filed in U.S. District Court in San Francisco by former AAF “front office” employees against Legendary Field Ventures LLC (headquartered in San Francisco) and ancillary defendants such as investors, AAF officials, and NFL notables, Troy Polamalu and Jared Allen.
According to “The Mercury News” the suit may later encompass other AAF employees, players, and other workers, however, the suit which was filed on 8 April 2018 named the plaintiff as Jay Robeson, (former vice president of operations), and John Swope (vice president of corporate sponsorships), was also named as a plaintiff on Tuesday. Both were employed by the Birmingham Irons.
The overarching premise of their lawsuit is based on the federal Worker Adjustment and Retraining Notification (WARN) Act which stipulates that corporations must provide at least 60 days’ notice prior to enacting sweeping layoffs.
The suit is looking for remuneration of wages and other benefits which would have been accrued within the 60-day notice period. The suit will also be the vehicle which determines whether class certification is possible and will handle other administrative details.
If it is determined that a class action suit is warranted, a judge will make the determination on who is included.
